Absolutely, but an even more likely explanation is that he's going to "acquire" Tesla with Space X and pay a premium (on top of the 330 P/E!). The SEC in this country is completely useless. Sure you can't invest in private companies if you're not an "accredited investor" but Musk is free to scam trillions of dollars.
