The Federal Court is already Australia's second-highest court. The only higher level is the High Court, and like the US Supreme Court, they're quite picky about what appeals they'll accept.

They’re not that picky. The Australian banks lost their case against Apple, when it came to Apple Pay and their collusion to stop it. So of course Apple is going to appeal to the highest court.
