nondisclosure of compensation package and disparagement clauses are usually on the contracts as well. People don't want to tip off the H1B guy he makes 40% less than the dude standing next to him. =3
I was making over market rate on H1B. The petition process forces the employer to pay market rate or above.
Also the transfer petition is very easy and it usually takes 2-4 weeks. You can argue that changing jobs is higher friction for H1B workers, but if you are offered more salary elsewhere but decide to stay, well, that’s kind of on you, not the H1B process.

If your comp package has a non-disclosure clause it's illegal. You cannot be asked not to discuss salary in the US.
> People don't want to tip off
That's why it's illegal to be prevented from discussing salary. Discuss your coworkers - you might be the one being underpaid.
ymmv, things like employee at-will contracts are illegal in my area, technically unenforceable, and yet everyone still signs the form.

"study of H-1B wages shows up to a 30% discount for H-1Bs in certain occupations and an average of 16% discount for H-1Bs compared to American workers similarly situated." ( 2026, https://iaproject.org/commentary/new-analysis-says-h-1b-work... )
Perhaps the people I knew were just unlucky =3
