Usually the way it works is that _using_ the software is illegal, but distributing its source code is not. Code is covered by the first amendment in the US.

Unfortunately, the DMCA 1201 court decision that establishes once and for all has yet to occur. EFF continues to pursue it though: https://www.eff.org/cases/green-v-us-department-justice
