Easy! Government lawyers troll through the 180,000 pages of existing federal regulations, looking for some tangentially related law which is broad enough so as to be interpreted to include AI--thus giving the Executive branch the power to regulate AI.
The fact that you are right disgusts me (nothing personal intended!)
I presume, they use AI for that.
