How is that different from a malfunction of human-operated car?

There are drive-by-wire cars on the road. ABS systems can disable breaks.

If a malfunction is caused by the control software of that car or a mechanical malfunction by bad design it seems to me like the same thing. Do you/we don't have a solution for that already?
