I see that you are unaware of basic legal/moral concepts like “negligence” [1] if you think such standards are inhumanely cruel.
Thankfully, legal systems are not that inhumanly stupid.

negligence as a cause carries a different legal weight than malicious intent, eg. manslaughter is a different crime that murder. a system that disregards intent, as you seem to be advocating with statements like "any stupidity indistinguishable from malice should be treated the same." would treat manslaughter and murder as the same crime.
